Our California Elder Law Center Team

The California Elder Law Center team is headed up by Michael McGuire, Elder Law attorneys, and is fully accredited by the Veterans Administration, having represented clients accessing an average of $10,000,000 a year in benefits for seniors. Michael McGuire has also served a term as President of the SoCal NAELA group, engaged in educational presentations for attorneys, CPAs, executives of the care provided industry, including presentations in San Francisco, Washington, D.C., Dallas, Texas and San Diego, California. McGuire served a term on the Curriculum Board of the California Department of Insurance, been a member of professional advisory boards on the creation and implementation of advocacy committees, annuity regulations and long-term care training materials. McGuire has headed or been a member of stakeholder groups in California and on a national level, in addition to chairing the largest diversity and new attorney educational meeting among elder law attorneys in the U.S. He hosts a radio show, “Elder Answers” on KNEWS 94.3 FM/970 AM.

Understand What is Available and When: Medi-Cal Long-Term Care and VA Aid & Attendance

As leading advocates for seniors in Sacramento and Washington, D.C., the California Elder Law Center has focused for years on supporting families facing Alzheimer’s Disease, dementia, Parkinson’s Disease, Lewy-Body Disease, strokes, diabetes, broken hips or the inevitable frailness of old age of a loved one or spouse. According to the Director of the California Department of Health Care Services (DHCS), Mr. Toby Douglas, 70% of people in California over the age of 65 will require Long-Term Care during their lives. Medi-Cal, the California version of Medicaid, according to the DHCS “…may pay for some or all of your nursing home expenses.” Further, the DHCS is quoted as stating, “…you may keep all or some of your savings.” And finally, “Your home is an exempt resource.” That all translates into you being able to count of immediate help to address the overwhelming costs of a catastrophic illness. The California Elder Law center has supported the Alzheimer’s Association for years and hundreds of families engaged in support groups, educating them and providing them access, in many cases, to as much as $90,000 per year in public benefits to help pay for Long-Term Care. You can expect as much as $25,000 per year, tax free, if a veteran or the spouse of a veteran for care to help stay in your home or to use towards care in an assisted living or board and care facility.

The Medi-Cal Example

Medi-Cal may pay for all or some of a person’s stay in a nursing home. Currently (and the rules change every year, so be sure to call 760-422-0404 for free updates), the published average cost of one month in a nursing home is $7,549. Even if the person has been in a nursing home for an extended period of time (a recent client had paid over $5,000 per month for four years for her mother, only to discover with one short consultation, she wouldn’t need to ever pay for her mother’s stay in the nursing home ever again…and still keep the house safe!)a married couple may keep as much as $119,000 in assets in addition to their home. The California Elder Law Center has developed the Three-Step Process© to determine if a person is eligible, if they are qualified and to submit a winning application, THE FIRST TIME, EVERY TIME.

VA Example

The VA has a benefit that pays for care of a veteran or the spouse of a veteran that takes place in their home, in an assisted lining or board & care facility. The same Three-Step Process© applies to VA benefit processing and the results have been wonderful for the clients of the California Elder Law Center. Protected by the VA through the accreditation process, handle with the dignity and respect our veterans deserve, nearly 1,000 families throughout California have enjoyed the benefit of having the California Elder Law Center support and protect their rights to access up to $25,000 in tax-free benefits. A recent client, with an income limited to $1,532 per month from social security benefits was awarded an additional $1,754 per month from the VA to defray the cost of being in an assisted living facility in Palm Desert, California, bringing his total monthly funding to $3,286, relieving his children from subsidizing their father’s care. A true ‘Win-Win’ for that family!
